ARG Buyer Cash Rebate Policy
All advertised new home rebates are limited service rebates and may not appy in situations where ARG is required to show pre-existing MLS listings and generally working one on one in person as your buyer agent.
In an effort to comply with changing laws and regulations resulting from the recent real estate melt down, banking crisis and resulting recession, the following rebate conditions now apply.
All cash rebates paid by ARG are always based upon the "Commission sales price" of the home you purchase. If a builder pays ARG based upon a lower base price, then your commission rebate will be calculated based upon that price. Your HUD-1 closing statement will show the commission being paid to ARG.
All cash rebates are subject to the consent of the Principals (Clients) we (ARG) represent. Meaning if ARG is representing a specific party in a real estate transaction, we need that party's consent before providing a cash rebate to that party accroding to Texas Real Estate Laws. Normally this is accomplished via a buyer representation agreement where the rebate amounts and terms of our services are mutually agreed upon. Rebates may also be used towards a buyer's closing costs and prepaids, but never towards a buyer's down payment. Other uses of ARG's buyer cash rebate may involve reduction in price permission, or adding upgrades to your new home up to the amount of ARG's rebate credit.
Standard of Practice 12-3 Realtor Code of Ethics "Sharing Fees"
- "The offering of premiums, prizes, merchandise discounts or other inducements to list, sell, purchase, or lease is not, in itself, unethical even if receipt of the benefit is contingent on listing, selling, purchasing, or leasing through the REALTOR® making the offer. However, REALTORS® must exercise care and candor in any such advertising or other public or private representations so that any party interested in receiving or otherwise benefiting from the REALTOR®'s offer will have clear, thorough, advance understanding of all the terms and conditions of the offer. The offering of any inducements to do business is subject to the limitations and restrictions of state law and the ethical obligations established by any applicable Standard of Practice." (emphasis added)
ARG commisison rebates are always based upon the "Commission Sales Price" of your new home. What this means is your ARG rebate will be based upon the 3% commission reported on your HUD-1 closing statement. Any cash rebate paid by ARG is also dependent upon ARG being compensated first per the terms agreed upon by the new home builder's compensation plan. Your new home contract should indicate what price the builder will base their commission upon to ARG and what ARG will use to base our rebates upon. If for example their commission is based upon a "base" price, or initial contract sales price, then your rebate from us will be based upon that commission amount.
Other conditions may apply from RESPA (Real Estate Settlement Procedures Act) and as such ARG's rebate policy can change from time to time and without notice as Federal and State laws warrant.
LIMITS OF REBATE OFFER
ARG provides cash rebates for client home purchases with a contracted sales price of $200K or more as long as we do not show more than 15 homes. After 15 showings, ARG's cash rebate offer will no longer apply. There is no minimal price limit to receive a rebate on a new home purchase.
Rebate amounts shown on this website are not guaranteed and may be less or more depending upon factors outside of our control. For example, if for reasons outside our control, a rebate amount suddenly changes, we will inform our clients as soon as we are made aware. Rebates may also change based upon commission program changes by new home builders. Special non-standard rebate offers may also have time limitations that are beyond our ability to control. If for any reason when the buyer agent commissions being offerd is less than 3% then rebates will likewise be adjusted lower and in some limited instances not offered. In no case shall any cash rebate offer be more than the commission paid to ARG and in no case will ARG pay out a rebate if we were not firstly compensated.
All 3% new home rebates offered by ARG are limited service non in field rebates and are dependent upon various new home builder's 3-4-5 escalating commission structure for agents. Absent this 3-4-5 program, ARG's limited service rebate will be fixed at 2%. Essentially ARG will return the full typical 3% buyer agent fee to our clients when you purchase a new home from a builder who offers a "3%-4%-5%" agent program and ARG will retain all amounts over 3% if any. Any fees paid to ARG over 3% and which may be shown on your HUD-1 closing statements represent dollars earned and derived from the sale of other new homes to other ARG clients. These dollars earned from other sales are not rebateable under any circumstances. Please refer to 3% Rebate Qualified New Home Builders.
Please be advised that some home builders pay a commission based upon list price before upgrades and or on the initial contract price. In this case rebates will be based upon this list price or commission sales price and or initial contract dollar amount. Actual cash rebates that are advertised on this website will always be calculated as a percentage of the sales price shown.
Commission FREE New Home Move up Program
ARG offers a completely commission free new home move up for select new home builders shown on this website. Actual cost for ARG's "Free" move up is based upon the "Commission calculated Sales Price" of the home you are selling and the "Commission Calculated Sales Price" of the home you are buying. As long as that difference is $50K or more, and the builder is an ARG eligible builder, your total net listing fee cost will equal ZERO DOLLARS, ZERO PERCENT or 100% FREE (all 6% avoided). This new home move up offer is always in lieu of our advertised buyer cash rebate offer. This means one or the other will apply but never both.
Relocation Company and Cash Rebates
If you are working with ARG and you are under a relocation agreement that requires us to pay them part of our buyer agent commission, then ARG's cash rebate credit will be less by the amount that we pay to your relocation company.
Advertised Rebate Credit Amounts Derived from MLS
Rebate amounts shown in MLS on this website are derived and calculated based upon a 3% Buyer agent commission being offered. You understand that the MLS IDX feeds sent to mckinneyhomerebate.com do not disclose buyer agent commissions (agency commissions) and hence you agree to hold ARG harmless in the event that the actual advertised rebate shown on this website is less as a result of the acutal commission being offered in MLS is less than 3%.
Limited Service Rebates for new homes mean a higher cash rebate amount (3%) to our clients who consult with and register us with their new home builder. ARG advertises all new home content on this website showing limited service rebates. Limited service means we consult with you via phone or internet and provide advice, answer questions and help you select a suitable location and builder. We then help you negotiate and finalize your contract on your new home. There are no cash rebates offered on homes for rent.
